You should really check into the small claims rules for OK. Every state is a little different although most have a hard cap. It doesn't matter what it would cost in most cases to redo the work, you would only be able to sue up to the cap in small claims. If it is over that cap you would have take it to superior court. At that level, both parties may bring in lawyers though. In both cases the loser can get dinged for the winners legal fees.
The other danger is that you win and he just closes his business and reopens as a new business. It happens all the time to dodge judgements.
I had a guy come look at it today that builds pads for Home Depot and dollar generals and whatnot, so he knows his stuff. The concrete cured out just fine, and actually doesn't look near as bad as those initial pics anymore. His advice was to go ahead and build my shop, then he will come diamond grind everything smooth and we can use an epoxy leveler and throw in some color and flake and it will be just fine.
The issue with suing this dipshit is that I will have a ton of money wrapped up in a lawsuit and if I win I will end up getting my money in $100 increments for the next 10 years. Still have some talking to do with my lawyer, but would settle right now for a refund for the labor portion of the bill to absorb the cost of the grinding/epoxy.
